Registration of Wills
Alderney residents should draw up separate wills for realty and personalty. The will of realty will include any land or property held in Alderney. The will of personalty includes everything else. Following the death of the testator the will of realty is registered in the Court of Alderney. The application can be made by a beneficiary or an Advocate. The original will and the death certificate, together with the appropriate fees, are required to register the will.
The Court produces an Act of Court, confirming that the Will of Realty has been registered. The Act of Court is then submitted to the Land Registrar to register the change in ownership of the property or land on the Land Register.
The will of personalty is not registered in the Court of Alderney, but is dealt with by the Ecclesiastical Court in Guernsey.
