Planning and Building Applications
Planning and Building Control both process and determine applications in accordance with the requirements of the Planning Law and Policy Guidelines and Land Use Plan [18Mb]. This page provides information regarding submitting an application for planning permission and building control approval along with information regarding the application process.

Please note that applications for Planning Permission are separate to applications under Building Regulations.
Planning Application form and guidance
Before you submit a planning application, check Do I need Planning / Building Permission?
Planning permission will be required in all cases for changes to Protected Buildings unless the contrary is specifically stated in the exemption.
We have produced guidance regarding
making a planning application [46kb]. An application form should be accompanied all supporting plans, drawings and documents.
Once all drawings, plans, forms and any supporting information are complete, they should be submitted with the correct fee to the Planning Office. Cheques should be made payable to 'The States of Alderney.'

If you are not the owner of the property or land please ensure you have owner's authority. You will need to confirm that in the planning application.
It is necessary for you to display a site notice to advertise your planning application.

Planning Application Fees
Fees are charged for planning applications but the costs of this vary depending on the type of proposal, unless you are entitled to an exemption or concession.
Payments for applications may be made by cheque or BACS.
Payments can also be made by credit or debit card at the General Office. A receipt should be obtained by customers to add to their application.
Cheques may be made payable to "The States of Alderney". American Express cannot be accepted.

Planning Application Decisions
All planning applications for development have to be dealt with consistently, in line with planning law and planning policies.
A decision on a planning application is made by the Building and Development Control Committee (BDCC) and can be made in one of two ways:
1) Delegated decision: The majority of minor, straightforward, and non-contentious applications are usually dealt with outside of a formal committee meeting, with a decision being made after the application has been publicly advertised for at least 21 days.
2) Open Planning Meeting Decision: At political level, the decision is taken by the elected members of the Building and Development Control Committee at their regular
Open Planning Meetings [182kb]. Applications which meet any of the following criteria will always be determined at the formal committee meetings:
(a) Where there is a departure from established policy
(b) The proposal appears to raise particularly contentious or sensitive issues
(c) A States Member has requested formal consideration at the committee meeting
(d) The application is by a States Member or a member of the Civil Service
(e) There is a chance of refusal
There are a number of outcomes from the decision making process and once the decision has been made a decision notice is produced as soon as possible (usually within 3 working days) which is then sent to the applicant, or agent where one has been appointed. Our website will also be updated with a copy of the decision notice following its issue by post.
i) Planning permission is granted: subject to conditions (including conditions limiting the period for which the permission is effective). A planning permission may have conditions attached which need to be complied with before works may commence (for example, details of landscaping may be required for approval). There is no fee for an application to discharge a condition. Planning approval normally runs with the land and conditions may continue to apply even once the development has been completed.
ii) Outline permission is granted: subject to conditions (that is, planning permission subject to the reservation of particular matters for subsequent approval) ????
ii) Planning permission is deferred: when further information is required from the applicant before the committee can make an assured decision.
iii) Planning permission is refused: as the applicant you have the right to appeal to the if you disagree with the decision to refuse your application, or a condition attached to a decision to permit your application.

Withdraw a Planning Application
A planning application can be withdrawn an at any time. If it is before the application has been processed then the fee can be refunded.
However, once the application process has begun no fee will be returned.
If the application has been deferred by the Committee, the applicant may decide to withdraw the application (for a number of reasons). Should the applicant wish to resubmit the application after a period of time, it will be added to the next open planning meeting agenda without incurring a further fee.
If the Applicant withdraws the application for a second time, no matter whether or not the application remains the same or is altered, the application will incur a fee and will be issued a new planning application number.

Building Regulation Application Forms
If you are carrying out building work you may need to make an application for a licence under the Building Regulations.
Please Note that applications under the Building Regulations are separate to applications for planning permission.
Before you submit an application you should establish whether you actually need to make an application for a licence under the Building Regulations, please check Do I need Planning / Building Permission? for information about 'exempt buildings and work' which are listed in

Owners Declaration [295kb] with your application.
